As anyone who has ever filled out an insurance form knows, the first question the insurance company asks is "was this injury job related." Josh's injury was definitely job related. He would have been dealing with Worker's Comp (or the equivalent for Federal Employees) and not his Insurance company.
Norma L. Nielson, Ph.D., CLU Ph.D. "in Insurance") who is Professor and Chairholder in Insurance and Risk Management reminded us of that when she wrote: "the injury to Josh would most definitely be considered 'in the course and scope of employment.' As such he would be entitled to workers compensation benefits under the Federal Employees Compensation Act. The benefit amounts under that law are significantly higher than many of the corresponding state programs and include full medical expenses."
